Suspect convicted in deadly Painesville Township home invasion wants new trial

Because of errors that occurred at trial a Tennessee man convicted in a deadly Painesville Township home invasion has filed a motion for a new trial. Timothy Markel Gaston, 29, was found guilty June 9 for the 2013 death of 23-year-old Matthew “Matty” Hammond, who was shot when Gaston and another man attempted to rob the known drug dealer. Gaston argued that he was not the shooter, and should and be retried. Gaston faces life in prison when he is sentenced July 24.
